to enjoy authentic and enriching holiday experiences whenever
you travel and we are committed to providing you with those
experiences.
We

Throughout
the following booking conditions, "We" or "we"
refers to the villa owners or their representatives.
1. BOOKING
of the property confirms the acceptance of the terms and conditions
set out below and shall be binding on the persons intending
to occupy the premises. Each booking will be confirmed as soon
as reasonably possible after receipt of signed booking form,
the deposit of 10% (or the full payment if booking within 6
weeks of arrival at the villa) and fee of $45/£30 in respect
of insurance premium for $1500 of Accidental Rental Damage Insurance
(ARDI) to cover your stay.
2. RESERVATION
DEPOSIT AND PAYMENT OF BALANCE
The full balance is payable no later than four weeks prior to
the date of arrival.
3. DAMAGE
DEPOSIT
In addition to the reservation, a credit card will be kept on
file. If the guest does not have a credit card we will need
a check or money order sent to us in the amount of $300.00.
The damage deposit will be refunded upon confirmation that no
loss or damage has occurred during the use of the property by
the parties to this agreement or, in the event loss has occurred
but the damage has been reimbursed to the owners through the
ARDI. In the unlikely event that the security deposit does not
cover the cost of any damage , loss, excessive cleaning costs
by our agents or excessive use of electricity (caused by leaving
external doors open with the air conditioning on) the difference
will be liability of the renter(s), who will be invoiced accordingly
on a joint and several basis. For the avoidance of doubt all
guests named on the booking form are liable for any invoice
raised for damage incurred in excess of the ARDI (to the extent
recoverable by the owners) and damage deposit. . If guests fail
pay any invoice rendered within 7 days the guest will also be
responsible for meeting any legal costs the owners and/or the
management company incur in full in recovering full payment
from guests.
4. CANCELLATIONS
BY GUESTS
If the outstanding balance has not been paid by the prescribed
time (6 weeks prior to arrival) we reserve the right to cancel
the booking in which event the deposit will be forfeit. If the
reservation is cancelled after the booking is confirmed, the
deposit will be forfeit. If the reservation is cancelled within
eight weeks of date of departure, the full rental will be forfeit.
All cancellations must be in writing. Emailed cancellations
will only be accepted if confirmed by fax or post within 48
hours of the date and time of any email sent.
5. CHANGES
BY THE OWNERS
Occasionally, the owners may have to make changes to and correct
errors on the website descriptions and other details both before
and after bookings have been confirmed. Whilst we always endeavour
to avoid changes, we must reserve the right to do so. If the
owners have to make a significant change to your booking, guests
will be told as soon as possible. The owners and/or their representatives
will endeavour to offer guests an alternative should a significant
change occur. The owners and management company regret that
they cannot pay any expenses, costs or losses incurred by guests
as a result of any change or cancellation
6 UNAVOIDABLE
CHANGES
We reserve the right under any circumstances to cancel the booking
and in this event we will return all sums (but without interest
or compensation) or we will endeavour to offer alternative premises
of comparable standard. In the event of a major change to the
booking being necessary, we will inform the client as soon as
reasonably possible, and if the client does not wish to accept
the booking on this basis we will cancel the booking and return
all moneys (but without interest or compensation).
7. COMPLAINTS
Should a problem arise relating to the premises the client should
contact our representative in Orlando. Details can be found
in the information folder, which is available in the premises.
8. LIABILITY
The owners and the management company of the property accept
no responsibility whatsoever for death, personal injury, accidents,
loss or damage to persons or personal belongings however caused.
The use of all accommodations and amenities is entirely at the
user's own risk. Children must be supervised by responsible
adults at all times when using the pool. Glass or crockery is
not permitted within the pool area. The owners or Management
Company cannot accept any liability for any loss of rental time
due to travel problem, flight delays or cancellations, industrial
disputes or any events outside our control, including any form
of Force Majeure. The owners and the Management Company cannot
accept responsibility for the sudden failure of villa equipment
but will take immediate reasonable action to rectify any such
failure upon notification by the guests. If the pool heater
cannot reach optimum temperature due to adverse cold weather
conditions the owners and/or the management company cannot accept
liability.
9. RESPONSIBILITIES
All persons stated on the booking form are responsible for the
care of the property and are expected to take reasonable care
of it including the locking of all doors, topping up of pool
water (as required). At the end of the rental period, all utensils,
carpets, furnishings, walls, fittings must be left clean and
tidy. It is the guest's responsibility to notify the management
company immediately of any sudden equipment failure so that
reasonable action can be take to rectify the situation.
10. PARTY
SIZE
The maximum capacity of the property must not be exceeded. Everyone
occupying the property must be listed on the booking form, including
small children. This is Florida state law and must be adhered
to. The accommodation will not be shared or sub-let and only
the persons shown on the booking form are permitted to stay
in the property. Persons under 21 years of age are not acceptable
unless accompanied by parents or responsible adults. The property
is fully licensed for short-term rentals in Florida. We reserve
the right to refuse admittance or evict guests (under chapter
509 Section 141) if this condition is not met. Failure to comply
will render the booking void and no compensation will be paid.
11. SMOKING/PETS
For the safety and comfort of all our guests smoking is not
permitted within the property. Strictly No pets are allowed.
12. CODE
OF CONDUCT
Your vacation home is based in a residential community.
The actions of all members of your party should not interfere
with the enjoyment of either other holidaymakers or the residents.
Please do not use the swimming pool, play loud music or engage
in any activity which may cause inconvenience to your neighbours
after 10.30pm or before 07.30am. In the event that any member
of your party behaves in a way that is likely to cause distress,
danger or annoyance to any other holidaymakers or residents
or damage to any property, we reserve the right to terminate
your rental agreement immediately and forthwith. We will not
be liable for any costs you will incur, nor shall we pay any
compensation, nor make any refunds due to this action
13. FORCE
MAJEURE
We accept no responsibility or liability whatsoever for any
loss or damage or alteration to the terms of the booking caused
by events beyond our control including, without limit, war,
civil commotion, flight delays or cancellations , adverse weather
conditions , fire, flood or industrial dispute.
14. AVAILABILITY
The premises will be available for occupation from 4pm on the
first day of the rental period and must be vacated by 10am on
the day of departure. A surcharge of one days rental will be
charged if the villa is not vacated by the specified time. Subletting,
sharing or assigning is strictly prohibited.
15. SAFETY
AND SECURITY
In the event that we or our agents need to gain access to the
property (for whatever reason) we will endeavour to give prior
notice but reserve the right to enter the premises at any time
for any reason.
16. DOCUMENTATION
All passports, visas and health certificate requirements are
the client's responsibility. We accept no responsibility for
any delay or expense incurred through any irregularity in such
documents.
17. PRICE
GUARANTEE
The price of renting the premises is fully guaranteed and no
surcharges will be added to the cost shown, Once a security
deposit and the ADRI premium has been received and cleared.
18. WEBSITE
DESCRIPTIONS
All brochure descriptions are made in good faith and every care
is taken to ensure their accuracy, but no liability will be
accepted in the event of any error or misrepresentations.
19. BEHAVIOUR
The owners and management company expect all guests to have
consideration for other people. If in our reasonable opinion
or in the reasonable opinion of any other person in authority,
guests or any member of the guests' party behaves in such a
way as to cause or be likely to cause danger, upset or distress
to any third party or damage to the property, or in any way
damage the reputation and/or goodwill of the owners we are entitled,
without prior notice, to terminate the occupation of the person(s)
concerned. In this situation, the person(s) concerned will be
required to leave the accommodation. We will have no further
responsibility toward such person(s). No refunds will be made
and we will not pay any expenses or costs incurred as a result
of the termination.
20. CONTRACT
This contract is governed and shall be interpreted in accordance
with US law and the parties hereto shall both submit to the
jurisdiction of the Courts of England and Wales.
